These Terms of Service ("Terms") apply to your use of blulabsports.com (the "Site") and any purchase you make from us. The Site is operated by ALLO COLLECTIVES LLC, doing business as Blulabs ("Blulabs," "we," "us," or "our"). Our store is hosted on Shopify Inc. By using the Site or placing an order, you agree to these Terms and to all policies referenced in them. If you do not agree, do not use the Site.

Please note: These Terms include a binding arbitration agreement and a waiver of class actions in the "Dispute Resolution" section below. Please read it carefully.

Products and descriptions
We try to show our products, colors, and descriptions as accurately as possible. However, we do not guarantee that product descriptions, images, or other content on the Site are error-free, complete, or current. Product appearance may vary depending on your screen. We do not guarantee that any product will meet your expectations.

Prices and availability
All prices are shown in the currency displayed at checkout and may change at any time without notice. Products are subject to availability. We may limit quantities, discontinue products, or modify or discontinue any part of the Site at any time without notice, and we are not liable to you or anyone else for doing so.

Orders and payment
By placing an order, you confirm that the information you provide is accurate and complete, and that you are authorized to use the payment method. We may refuse or cancel any order at any time and for any reason, including suspected fraud, stock issues, or errors in pricing or product information, even after your order has been confirmed or paid. We may limit or cancel quantities purchased per person, per household, or per order, including orders placed under the same account, payment method, or billing or shipping address. We may refuse orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors. If we cancel an order after payment, we will refund you in full.

Errors and inaccuracies
The Site may sometimes contain errors in product descriptions, pricing, promotions, shipping charges, delivery times, or availability. We may correct any error and update information, or cancel orders affected by an error, at any time without prior notice, including after you have placed your order.

Discounts and promotions
Discount codes and promotions are subject to their own conditions, may be limited to one use per customer, have no cash value, and cannot be combined unless stated otherwise. We may cancel orders or void discounts that we believe were obtained through misuse, fraud, or multiple accounts.

Shipping and risk of loss
Delivery times shown on the Site are estimates and are not guaranteed. Ownership and risk of loss pass to you once your order is handed to the carrier. We are not responsible for delays caused by the carrier, customs, incorrect address information you provide, or events outside our control. You are responsible for any customs duties, import taxes, or fees that apply in your country.

Returns and refunds
Returns and refunds are handled according to our Refund Policy, which is part of these Terms.

Chargebacks
If you have a problem with your order, please contact us first so we can try to resolve it. If you file a chargeback or payment dispute without contacting us first, or for an order that was delivered as described, we may dispute it, provide evidence to your bank, and refuse future orders from you.

Health disclaimer
Our products are not intended to diagnose, treat, cure, or prevent any disease. Information on the Site is for general purposes only and is not medical advice. Consult a healthcare professional before using any supplement, especially if you are pregnant, nursing, taking medication, or have a medical condition. Individual results may vary. You use our products at your own risk. These statements have not been evaluated by the Food and Drug Administration.

Product use and allergies
Use our products according to the directions and warnings provided on the product packaging or product page. You are responsible for reading the full ingredient list and warnings before use, including checking for any ingredients you may be allergic or sensitive to. Any use outside the provided directions is at your own risk. Stop use and consult a healthcare professional if you experience any adverse reaction.

Athletes and drug testing
If you are subject to drug testing or compete under the rules of any sports organization, including WADA, USADA, the NCAA, or any professional league, you are solely responsible for checking all ingredients against the banned substance lists that apply to you before using our products. Blulabs is not responsible for any positive test result, suspension, disqualification, or other consequence related to your use of our products.

Your account
If you create an account, you are responsible for keeping your login details secure, for keeping your information up to date, and for all activity under your account.

Prohibited uses
You may not use the Site or its content: (a) for any unlawful purpose; (b) to infringe our intellectual property or anyone else's; (c) to harass, abuse, or harm others; (d) to submit false or misleading information; (e) to upload or send viruses or harmful code; (f) to collect or track the personal information of others; (g) to spam, phish, crawl, or scrape; (h) to interfere with or get around the Site's security features; or (i) to copy, resell, or exploit any part of the Site or our products without our written permission. We may refuse service to anyone for any reason at any time, and may end your use of the Site for breaking these Terms.

Intellectual property
All content on the Site, including our name, logo, images, text, and designs, belongs to Blulabs or its licensors and is protected by law. You may not use it without our written permission.

Reviews, comments, and submissions
If you send us reviews, photos, comments, ideas, or other content, you give us permission to use, edit, copy, publish, and distribute it in any medium without payment to you, and we have no duty to keep it confidential or respond to it. You confirm that your content is your own, is accurate, and does not break any law or anyone else's rights. We may, but are not required to, remove any content we find unlawful, offensive, or in breach of these Terms.

Personal information
Your submission of personal information through the Site is governed by our Privacy Policy.

Third-party tools and links
The Site may include tools, content, or links from third parties that we do not control. We provide them "as is" without any warranty, and we are not responsible for their content, products, or practices. Your use of them is at your own risk and subject to their terms.

Disclaimer of warranties
The Site and all products are provided "as is" and "as available." To the fullest extent allowed by law, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Site will be uninterrupted, secure, or error-free, and we may remove or suspend the Site at any time without notice.

Limitation of liability
To the fullest extent allowed by law, Blulabs and its owners, officers, employees, affiliates, contractors, and suppliers will not be liable for any indirect, incidental, special, punitive, or consequential damages, including lost profits, lost data, or personal injury, arising from your use of the Site or our products, even if advised of the possibility of such damages. Our total liability for any claim will not exceed the amount you paid for the product involved. Some places do not allow these limits, so in those places our liability is limited to the maximum extent allowed by law.

Indemnification
You agree to defend and hold harmless Blulabs and its owners, officers, employees, affiliates, contractors, and suppliers from any claims, losses, or costs, including reasonable legal fees, that result from your breach of these Terms, your misuse of the Site or our products, or your violation of any law or the rights of others.

Events outside our control
We are not liable for any delay or failure to perform caused by events outside our reasonable control, including natural disasters, carrier or supplier failures, labor disputes, government actions, pandemics, or internet outages.

Dispute Resolution
If you have a dispute with us, you agree to first contact us at info@blulabsports.com and try to resolve it informally for at least 30 days. If it is not resolved, you and Blulabs agree that any dispute arising from these Terms, the Site, or our products will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. Either party may instead bring an individual claim in small claims court if it qualifies. You and Blulabs each waive the right to a jury trial and to take part in any class action, class arbitration, or representative action. You may opt out of this arbitration agreement by emailing us within 30 days of first accepting these Terms with the subject line "Arbitration Opt-Out." If any part of this section is found unenforceable, the rest still applies, except that the class action waiver may not be separated from the arbitration agreement.

Governing law
These Terms are governed by the laws of the State of New York, United States, without regard to its conflict of law rules. Any dispute not subject to arbitration will be handled only in the state or federal courts located in New York, and you agree to their jurisdiction.

SMS/MMS marketing messages
If you opt in to receive text messages from us, you agree to receive recurring automated marketing messages at the phone number you provide. Consent is not a condition of any purchase. Message frequency varies. Message and data rates may apply. Reply STOP at any time to unsubscribe, or HELP for help. You may also opt out by contacting us at info@blulabsports.com. Carriers are not liable for delayed or undelivered messages. You confirm that you are the owner or authorized user of the phone number. Our use of your information is described in our Privacy Policy. Disputes relating to text messages are subject to the Dispute Resolution section above.

Termination
These Terms remain in effect until ended by you or us. You may end them at any time by stopping your use of the Site. We may end them, or deny you access to the Site, at any time without notice if we believe you have broken these Terms. You remain responsible for any amounts owed up to that point, and any obligations or liabilities incurred before termination continue to apply.

Severability
If any part of these Terms is found to be unlawful or unenforceable, that part will be enforced to the maximum extent allowed, and the rest of these Terms will remain in full effect.

Entire agreement
These Terms, together with our Refund Policy, Privacy Policy, and any other policies posted on the Site, are the entire agreement between you and us and replace any prior agreements. If we do not enforce any part of these Terms, that does not mean we give up the right to enforce it later. Any unclear wording will not be interpreted against us as the drafter. Section headings are for convenience only.

Changes to these Terms
We may update or replace any part of these Terms at any time by posting the new version on this page. It is your responsibility to check this page for changes. Your continued use of the Site after changes are posted means you accept the updated Terms.
